In OSHA matters, OSEA can represent a client from the first day of inspection on through full contest and presentation at an administrative law hearing. Legal counsel would be suggested depending on the severity of the matter and liability issues of concern.

OSEA has assisted on some of the largest litigations undertaken by the U.S. Secretary of Labor against client companies.  These activities have included serious and tragic cases involving fatal accidents, alleged toxic exposures, process safety management and have encompassed both industrial and construction related issues. 

OSEA handles the conduct of inspections by regulatory agencies and has represented client companies on issues dealing with the implosion of Three Rivers Stadium, serious fall incidents on the Brooklyn Bridge, construction equipment accidents, falls and process safety matters.

OSEA has been selected and approved by both respondent and Secretary of Labor as a final arbitrator relating to a stipulated settlement dealing with an ongoing process safety inspection, tentative abatement and agreed engineering corrections. 

These matters, along with hundreds of other representations, have allowed OSEA to assist client companies with the proper defense of their position relating to citations received for safety and health violations.  Depending on need, OSEA provides assistance directly through client companies or through counsel.  Our in-depth technical research and knowledge very often allows counsel to dissect a case to provide the best strategy on defense and analyze a demanding regulatory allegation(s) versus actual facts and intent of rules and standards.

Environmental

OSEA has assisted with full due diligence investigation and oversight of a major corporate buyout dealing with multiple legal counsel and environmental consultants, reviewing site and operational situations. This includes Phase I, II and III investigations and programming.

OSEA has represented numerous clients in environmental situations inclusive of NYS Dept. of Environmental Conservation (alleged environmental violations), and representation with counsel on issues dealing with property matters/ receipt of notice of owners becoming potential responsible parties in environmental contamination.

OSEA provides full Phase I, II and II (Remediation Management) Environmental Investigations to clients.  Our understanding of state environmental rules and statutes, RCRA and CERCLA federal regulations, and associated Clean Air / Clean Water Act regulations provides client and counsel with the necessary understanding of the rules and obligations as promulgated.
